TERMS & CONDITIONS
Real Property Terms & Conditions: To register, a prospective bidder must provide name, residence address, phone number, and a valid driver’s license. By registering, a prospective bidder is acknowledging that he/she has read and agrees to be bound by the Terms and Conditions of Sale. The successful bidder must sign all documents & contracts upon the conclusion of the auction. A 10% non-refundable earnest money deposit will be required should successful bidding occur. Purchase will be accompanied by an additional 5% buyer’s premium. Buyers must close within 30 days of the auction date. The entire purchase price must be paid at closing in the form of certified funds. All announcements made the day of sale take precedence over any prior written or verbal terms of sale. Taxes are to be pro-rated at closing. Seller will furnish an Owners Title Policy at Closing.

ONLINE BIDDING TERMS
Notice: All bids are pending until you have been approved by Curtis & Sons, Inc. You will be notified of approval by an agent of Curtis & Sons, Inc. after completion of the following: (1) Create a HiBid profile. (2) Complete and Submit the Online Bidding Registration Form with Curtis & Sons, Inc.
Live Auction: The real estate auction will be conducted, in-person and online, live on Thursday, May 11, 2023 starting at 6:30pm CST. The property is located at South 725 Road, Bronaugh MO 64728. The property will sell by the acre to the highest bidder. Property is assessed at 39.591 acres. Online bidding is available starting no later than April 5, 2023. Bids can be submitted in advance or live on the day of the auction. Interested persons can participate in online bidding from their computer or mobile device by logging on and registering at www.CurtisAndSonsRealty.com/Auctions or CurtisAndSonsRealty.HiBid.com. When you place a bid, you are acknowledging that you have read and agreed to the terms and conditions.
Registration: All online bidders must register with a valid credit card, name, residence address, phone number, and valid driver’s license to participate in the auction. Online bidding is available for those who cannot be present at the live auction, however it is not required that you bid online. Proof of verified funds or lender pre-approval is required. Online bidders will be able to place an advanced bid and/or bid along with the live crowd during the actual auction. Registration is required at least 48 hours prior to the date of auction. Online: Curtis & Sons, Inc. and/or the Seller will not be held liable for any technical difficulties that may arise during the auction. As a registered online bidder, you are acknowledging that you understand that internet failure can occur. In the event of a technical glitch, Curtis & Sons, Inc. reserves the right to correct any technical or human error to amend any transactions before, during, or after the auction. Curtis & Sons, Inc. will give notice to bidders in the event of an error. Curtis & Sons, Inc. decisions are final.
Buyer Premium: A five percent (5%) buyer premium will be added to the high bid amount to determine the full purchase amount to be paid by the purchaser. The full purchase price for the real estate is defined as the sum of the final bid amount acknowledged and accepted by the seller, plus the five percent (5%) Buyer Premium amount which will be added to the high bid amount.
Example: High bid amount of $168,000 plus a 5 percent buyer premium of $8,400 making the purchase price $176,400.
Contract: If an online bidder is the successful high bidder at the conclusion of the auction, the Real Estate Contract will be e-mailed to the successful bidder at the conclusion of the auction. The successful online bidder must electronically execute or manually fill out the Real Estate Contract and e-mail back to Curtis & Sons, Inc. no later than 5:00 PM CST the following day of the Auction. If there are any discrepancies between these terms and conditions and the Real Estate Contract, the Real Estate Contract shall prevail.
Deposit: If an online bidder is the successful high bidder, (a) they may be subject to a non-refundable credit card hold in the amount of their per acre bid (Example: if you bid $168,000 you card may be charged $1,680 at the time of auction close). (b) they must deliver a minimum amount equal to 10% of the purchase price (inclusive of the buyer premium) to McFadden Land & Title by wire transfer or cashier’s check no later than close of business Friday, May 12, 2023. Online high bidder should contact McFadden Land & Title at 417-667-2882 for wiring instructions. Delivery of the cashier’s check may be made by that date between 8:30 AM & 4:30 PM to the offices of McFadden Land & Title which are located at 121 E. Cherry St Nevada, MO 64772. Winning online bidders whose documents and deposits are not received within the required timeframe are subject to having their bids removed and the property offered to the backup bidder.
Tenant Agreement: Property is cash rented for the 2023 crop season, with the rent being retained by the seller. The current tenant has rights to farm for the 2023 crop season. Possession will be given to the buyer at closing subject to said lease.
Closing/Possession/Taxes: Closing shall take place on or before and no later than June 12, 2023. The closing shall be conducted by McFadden Land & Title of Nevada, MO. Buyer is responsible for their portion of closing cost. The entire purchase price must be paid at closing in the form of certified funds. Buyer will receive possession as of the date of closing/funding and is subject to current tenant agreement. Any items in buildings and on property as of the closing date/funding shall become property of the Buyer subject to the current tenant agreement. The real estate taxes will be prorated to the date of closing. The 2022 property taxes are paid in the amount of $84.09. The 2023 taxes and beyond will be paid by the new buyer(s). Seller will furnish an Owners Title Policy at Closing.
Minerals: All mineral rights owned by the seller (if any) shall transfer with the surface.
Agency: Curtis & Sons, Inc. is acting as an agent for the seller. Curtis & Sons, Inc. reserves the right to remover or cancel the bids and or bidding rights and privileges of any part, deemed not to be in the best interest of the seller. Curtis & Sons, Inc. or sellers may cancel the auction at their sole discretion any time prior to the execution of the Real Estate Contract.
Seller Approval: This sale is contingent on the seller approval. The seller reserves the right to refuse or accept the final bid.
Disclaimer: This real estate is being sold “AS IS, WHERE IS” with no contingencies. This auction is not contingent on or subject to the purchaser being able to obtain financing. Bidders must do all of their due diligence prior to the end of the bidding process. The auction isn’t over until the auctioneer announces the completion of the auction. There may be a brief recess to confer with the owner/seller to confirm the bid price.
